Patent Status of HIV Medicines


Data were derived from the Medicines Patent Pool’s patent database that provides information on the patent status of selected HIV medicines in low- and middle-income countries. They reflect the situation of June 2015 and include the last updates made until this date.


In the case of the African Regional Intellectual Property Organization (ARIPO) granted patents are only valid in member States designated in the respective application. As the current version of the MPP database only contains information on the patent status in ARIPO in general, we identified the designated countries for all shown patents that were filed or granted by ARIPO using the search tool of the online database provided by this organization. Currently, 18 Member States have joined ARIPO, namely Botswana, The Gambia, Ghana, Kenya, Lesotho, Liberia, Malawi, Mozambique, Namibia, Rwanda, Sierra Leone, Sudan, Swaziland, Tanzania, Uganda, Zambia, Zimbabwe, and since August 2014, the Democratic Republic of São Tomé and Príncipe.


In the case of the African Organization of Industrial Property (OAPI) patents granted by this regional organization are effective in all OAPI member States. At present there are the following 17 members: Benin, Burkina Faso, Cameroon, Comoros, Central African Rep., Chad, Congo, Equatorial Guinea, Gabon, Guinea, Guinea Bissau, Ivory Coast, Mali, Mauritania, Niger, Senegal, and Togo.
